Euskadiko Kirol Portuak (EKP) has sent the resolution proposal for the allocations to the court, along with the plan to hold the necessary draw in December to complete the procedure. This new allocation will ensure compliance with the judicial rulings that annulled the initial allocations.
The progress follows a judicial order on October 14, which resolved an execution incident raised by EKP and validated the withdrawal of a claimant's request for a new procedure. The ruling upholds the annulment of the 2021 allocations and allows for a new allocation based on the terms of the call approved on January 20 of that year.
The procedure originated from appeals filed against the allocation of berths approved by EKP in 2021 for the pontoons of the Plentzia sports marina. These appeals led to ten final judgments ordering the annulment of the allocations.
After analyzing the judgments, EKP decided to revoke that allocation. Simultaneously, it granted temporary and revocable authorization for the vessels occupying the facilities to remain until the new procedure was completed.
The rulings introduced a new berth allocation criterion based on optimizing water surface use by combining vessels of different dimensions. However, the existence of final rulings with partially incompatible criteria compelled EKP to initiate the execution incident now resolved, in order to specify how the judgments should be applied and which procedure should be followed.
Throughout this period, the entity has worked to balance the maximum utilization of moorings with respect for the equality principles established in the original call. To this end, it has received specialized external advice in mathematical calculation and combinatorics, whose work has formed the basis for the proposal submitted to the court.
