Pasaia: Port Authority wins parking dispute against City Council

The Basque Country High Court of Justice upholds the Port's appeal, invalidating parts of the municipal parking ordinance.

A legal dispute between the City Council of Pasaia and the Port Authority (APP) has intensified following a ruling by the Basque Country High Court of Justice (TSJPV) in favor of the Port.

The ongoing conflict between the City Council of Pasaia and the Port Authority (APP) has escalated after the Basque Country High Court of Justice (TSJPV) ruled in favor of the Port. The court declared article 4.5 and the first annex of the municipal parking ordinance null and void, as they included spaces belonging to the port's public domain.
The ruling orders the City Council to pay legal costs, capped at one thousand euros (excluding VAT). Despite this, the municipal government views the decision as a reinforcement of its stance, asserting that the judgment acknowledges the council's authority over traffic and urban mobility in port areas integrated into the town's urban fabric.
According to the council, the TSJPV concluded that since both administrations have competencies in certain areas, parking regulations should be established through collaboration. Consequently, the ordinance's application in affected port zones is suspended until an agreement is reached.
The mayor of Pasaia, Teo Alberro, stated that the ruling recognizes municipal powers over urban traffic and clarifies that the Port Authority cannot act as if the entire port domain is exclusively for port use, especially when these are areas used daily by citizens. He recalled that the ordinance was created to address parking shortages and pressure on districts, prioritizing resident use.
Port sources, however, have criticized the City Council's communication as "falsehood" and emphasized that the court upheld their appeal. Both parties are scheduled to meet again this Friday to attempt to resolve the situation.
