The Errenteria City Council approved yesterday the new ordinance that will regulate the application of the tourist stay tax within the municipality. The motion passed with affirmative votes from EH Bildu, Elkarrekin Podemos, the Socialist Party, and the Basque Nationalist Party, while the Popular Party abstained. This new tax will come into effect on January 1, 2027, after its processing is completed.
The ability to implement this new tax stems from the approval by the General Assemblies of Gipuzkoa, on June 12, 2026, of the Provincial Decree 3/2026, which governs the tax on tourist stays in the municipalities of the Historical Territory of Gipuzkoa. The approved ordinance establishes the minimum tariffs foreseen in the provincial regulations for different categories of tourist accommodations.
Considering the current offering in the municipality, the tariffs are set as follows: one euro for 2-star hotels, 0.50 euros for agrotourism establishments, 0.75 euros for rural houses, and 6.50 euros for tourist-use dwellings, which will be subject to the maximum tariff. This measure aligns with the housing policies being developed under the designation of Errenteria as a Stressed Housing Area.
The new tax will apply to temporary stays, aiming for visitors to contribute to the maintenance of municipal services. The tax is levied per stay unit, meaning per day or part of a day a person spends in a tourist accommodation. Stays of less than 24 hours will also be considered a single unit, and for each continuous stay in the same accommodation, a maximum of six units will be charged.
The regulations also include several exemptions. These include stays by individuals under 18 years of age, those made for health, disability, or dependency reasons, as well as those related to studies, research, social programs, or force majeure situations.
The decision made by the City Council will be made public for a period of 30 business days. During this time, interested parties will have the opportunity to submit claims and observations.
