The socialist party has reaffirmed its stance in favor of equal access to public employment after learning of a judicial resolution that annuls the PL3 linguistic profile requirement for the first agent positions in the Municipal Police.
It considers that this ruling supports the position it has been defending since September 2025 regarding the need to adjust linguistic requirements to the actual functions of each position.
EH Bildu, for its part, requests the Eibar Municipal Government to file an appeal against the sentence. This group links the judicial opinion to the judicial offensive against linguistic profiles and, by extension, against the Basque language.
EH Bildu states that these sentences hinder the progress of Basque language normalization and condition the work of institutions.
The PSE-EE values the judicial resolution, considering that the linguistic profile requirement is not properly substantiated in relation to the job functions and warns of the disproportionate nature of the requirement, "which may hinder —it points out— the coverage of essential positions for the proper functioning of public services".
The Eibar PSE-EE recalls that, within the framework of the last review of the Municipal Job Classification (RPT), a proposal was made to adjust linguistic profiles to the sociolinguistic and technical reality of the municipality, "with the aim of guaranteeing effective coverage of positions, especially in essential areas such as public safety".
However, this approach did not receive the endorsement of the PNV and EH Bildu municipal groups, who advocated for maintaining more stringent criteria regarding linguistic profiles, considering the levels established in job planning to be adequate.
Another aspect highlighted by the sentence is the existence of a high number of positions with expired mandatory requirements, as indicated by the socialist group. Specifically, the figure registered by the Eibar City Council is significantly higher than what would correspond to the existing sociolinguistic reality in the municipality, which, according to this interpretation, indicates a mismatch in the planning of linguistic profiles.
The PSE-EE values that the ruling underscores the need to balance the public's right to receive public services in Basque with the right of access to public employment on equal terms, preventing excessive requirements from causing exclusion or hindering the coverage of vacancies.
As a consequence of this resolution, the affected selection process has been nullified, and the City Council will have to proceed with the review and modification of the positions to eliminate requirements considered disproportionate, especially in cases where candidates with a PL2 linguistic profile were excluded despite having sufficient professional qualifications.
EH Bildu interprets the sentence in the opposite way, considering that it does not take into account the close relationship between municipal police officers and citizens, nor the role that the use of Basque plays in that interaction.
«Municipal police officers are among the public employees with the most direct contact with citizens, so it is the responsibility of the City Council to guarantee the linguistic rights of the population in these interactions».
Furthermore, EH Bildu highlights that the Eibar City Council has both internal plans and municipal strategies to promote the use of Basque and believes that this sentence fully contradicts these objectives. This argument has led them to request the Municipal Government to appeal the judicial resolution, which they consider an attack on the autonomy and decisions of the City Council.
EH Bildu also focuses on the limitations of the legal framework regarding Basque language rights.
In fact, it recalls the importance of advancing the debate on the reform of Basque public employment to guarantee the legal certainty of linguistic profiles and has highlighted EH Bildu's stance in facilitating the processing of the PNV's reform proposal in the Basque Parliament, despite having its own proposal, to prevent both initiatives from being blocked.
Finally, it indicates to the PSE-EE that it has the responsibility to defend the interests of the City Council and underlines this institution's commitment to promoting the use of Basque in the municipality, therefore considering it appropriate to take the necessary measures to guarantee the linguistic rights of the citizens.
