Beraza Uriarte Family Ends Legal Battle Over Iurgi's Death

Five years after their son's fatal hit-and-run in Aulesti, the parents conclude their judicial process, despite securing a conviction against the insurer.

Five years after young Iurgi Beraza Uriarte lost his life in a hit-and-run accident in Aulesti, his parents, Josu Beraza and Miren Agurtzane Uriarte, have decided to conclude their legal battle.

Despite achieving a conviction against the insurance company, resulting in a compensation of just under 219,000 euros, the family has issued a statement expressing their "firm disagreement" with a process they deem insufficient and detached from the reality of what occurred in May 2020.

"On the one hand, we have received it well, because guilt is proven, but we remain angry because not everything necessary has been investigated to know the truth."

The core of the family's complaint lies in the police's actions. They state that the original police report classified the incident as a "fatal misfortune" without conducting a thorough technical investigation. The parents highlight contradictory expert reports regarding basic elements such as vehicle speed and impact dynamics. Furthermore, they maintain their criticism of the Ertzaintza's conduct during the investigation and question the impartiality of the instructing officer.
Although the sentence itself acknowledges conflicting versions and a context of uncertainty, the parents have announced they will not appeal. This decision is not based on conformity, but on the "human need" to end a process they describe as "emotionally devastating".
After five years of "judicial ordeal," the Beraza Uriarte family believes it is time to try and rebuild their lives and dedicate their energies to grieving their son, something they consider incompatible with prolonging legal proceedings. The note sent to DEIA concludes with an appeal to institutions to ensure that investigations into fatal accidents —especially those involving minors— are conducted with the utmost rigor and transparency, preventing other families from experiencing the same feeling of injustice.
