A report commissioned by the Basauri City Council from an external company, following a neighbor's complaint, has identified urban planning irregularities in several constructions. While some of the issues raised by the complainant have been dismissed, infractions have been found in other areas.
In two of the affected buildings, one already built and the other under construction, located at the corner of Lehendakari Agirre and Autonomía streets, the neighbor alleged greater buildability than authorized. The report indicates that the constructions comply with the maximum authorized alignments and do not encroach on municipal land. However, there is "additional buildability within the property," meaning "the adequate division between land for residential use and that for services has not been respected," according to City Council sources.
The complaint also alleged that some spaces were being used as dwellings when they were authorized as storage rooms. The City Council emphasizes that "all granted building permits comply with the law," but signs of possible infractions in this regard have been discovered in the RE-6 building, located in Plaza Arizgoiti.
Given that "the statute of limitations for the infraction may be imminent," the municipal legal services have proposed "notifying the owners that if their unauthorized use is confirmed, residential use will be suspended." They also propose "initiating a sanctioning procedure against the building's developer," the Eibar group.
The City Council's legal services are currently analyzing the document's content to prepare a resolution proposal that will determine the measures to be taken. The governing team reports that this proposal will be communicated to the owners, other political parties, and the public, presumably "by the first half of July."
