The union stated that the conflict cannot be considered closed until a collective agreement incorporating what was agreed upon is in place. Six months after the pre-agreement was signed, the situation at Avanza Movilidad Gipuzkoa remains unresolved, with the conflict still open and no collective agreement in force.

ELA criticized that at the time, the agreement was presented to the public as the end of labor tensions and an improvement in staff conditions. Even the provincial deputy for Mobility stated that "the situation that existed in Avanza no longer exists".
However, the union has pointed out that this statement does not align with the current reality. During a meeting with the Basque Government on April 15, it became clear that the company has no intention of ratifying the pre-agreement under the terms agreed for its inclusion in the collective agreement.
For ELA, Avanza intends to introduce unilateral modifications to what was agreed in the mediation process, in which the Deputy Ministry of Labor participated as a guarantor. The union believes this constitutes a serious violation of the consensuses reached in collective bargaining, by not respecting an agreement signed in mediation. Therefore, the union will promote an indefinite strike based on the demands raised in July 2025, with the aim of guaranteeing a dignified agreement for all staff. This strike would affect the lines between Bilbao, Donostia, and Gasteiz, Loiu-Arrasate, Loiu-Donostia, Loiu-Gasteiz, and all lines in the Deba valley.
