Usurbil City Council Publicly Exhibits File to Declassify Atsobakar Plot

The Usurbil City Council unanimously approved on March 26 the declassification of a plot in the A-108 area of Atsobakar, as it has no public use, and has now publicly exhibited the file for one month.

The Usurbil City Council, in its plenary session on March 26, unanimously approved the declassification of a municipal plot located in the A-108 (Atsobakar) area of the Subsidiary Urban Planning Regulations. This decision means the plot will become patrimonial property, allowing for a future sale. The file will be open for public exhibition for one month, starting the day after its publication in the Official Gazette of Gipuzkoa and on the municipal notice board, counting from April 24.
As explained by the municipal government team, declassification is the loss of public domain status for a property when it is no longer assigned to a public use or service. In this case, the Usurbil City Council received the Atsobakar plot in 1999, but since then, no public use has been established there, nor is it foreseen for the future. Therefore, the plot is not linked to an effective public use.
Furthermore, the Strategic Plan for Physical Activity and Sport approved by the City Council for the 2022-2026 period also does not contemplate any use for the Atsobakar plot. The council has other reserve plots to meet future sports equipment needs.
In this context, the Lasarte-Oria City Council, bordering Usurbil, expressed its intention to acquire this plot to expand and improve its sports facilities in Atsobakar. As a result, both city councils signed a collaboration agreement last year to regulate the actions and conditions for the direct transfer of the plot. According to this agreement, the direct award and transfer of ownership will be formalized by public deed within a maximum period of two months, counting from the entry into force of the General Urban Planning Plan (PGOU).
The municipal government team has indicated that the declassification is legally viable, as there is no specific regulation preventing it, and it has an adequate and reasoned justification of public interest. Therefore, it has been decided to exhibit the file to the public as a necessary step to advance the sale process.
