The Spanish Foundation of Christian Lawyers has filed a complaint with the Investigating Court of Donostia against rapper Tokischa for an alleged crime of desecration, following the publication of sexually explicit images taken inside the Basilica of Santa María del Coro.
According to the organization's statement, the artist "appears semi-naked —topless and wearing only an intimate garment (thong)— posing provocatively inside the temple," directly in front of an image of Jesus Christ, "using the sacred space as an erotic setting, completely alien to religious worship".
The images are part of the "planned aesthetic" for a short film, which, in the opinion of the complainants, "evidences premeditation and the conscious use of a Catholic temple for commercial and exhibition purposes, distorting its religious meaning." It is noted that the events have had "great public transcendence," generating "deep indignation and offense in the community of Catholic faithful".
The legal organization believes that these acts could constitute a crime of desecration as outlined in article 524 of the Penal Code, as they are actions carried out in a temple "with an evident offensive character towards religious sentiments, through the disrespectful use of a sacred space and its symbols".
The Diocese of Donostia, for its part, has requested the video's production company, in which the Dominican rapper appears semi-naked inside the basilica of Nuestra Señora del Coro, to remove the images disseminated on social media. The diocese indicates that it is evaluating whether the events require legal or canonical actions and that it had already contacted the production company, reminding them that authorization for the recording was denied at the time. The Diocese deeply regrets "the improper use of a sacred space" and emphasizes that these images hurt the religious sensibilities of the faithful and are incompatible with the respect due to the place.
