The High Court of Justice of the Basque Country (TSJPV) has proposed an increase of between 5 and 8 new judges for the judicial system in Gipuzkoa, with a total of 15 to 31 new positions for Euskadi, aiming to address urgent justice needs by 2026.

This proposal seeks to respond to the pressing demands of the Basque judicial system and its implementation will depend on the confirmation of provisions outlined in the draft royal decree from the Central Government. This draft anticipates the creation of 500 new judicial units across Spain, with 14 of these allocated to the Basque Country.
The Governing Chamber of the TSJPV approved the proposal, which was developed after analyzing the workload of various Basque judicial bodies in recent years. It also considered criteria established by the General Council of the Judiciary (CGPJ) and the Ministry of Justice, which set the benchmark for creating new judicial units as exceeding 130% of the entry module for five consecutive years.
Three scenarios are presented. In the first, if the royal decree's provisions are not confirmed, the TSJPV proposes creating 31 new judicial units in the Basque Country. Eight of these would be in Gipuzkoa: three in the Civil Sections of the courts of first instance in San Sebastián, two in the Criminal Sections of San Sebastián, one in the Section for Violence against Women in Donostia, one in the Single Section of the courts of first instance in Irun, and one in the Civil Section of the Gipuzkoa Provincial Court.
The second scenario considers the creation of the 14 positions for the Basque Country as outlined in the royal decree. In this case, the TSJPV suggests 17 new positions, six of which would be for Gipuzkoa: two for the Civil Sections in Donostia, two for the Criminal Sections in San Sebastián (one with exclusive and non-exclusive jurisdiction in criminal enforcement), one in the Section for Violence against Women in Donostia, and one in the Single Section of the courts of first instance in Irun.
Finally, a third scenario envisions the confirmation of the royal decree's expansion provisions and the transformation of the two territorial attachment judge positions planned for Euskadi into the Sections for Violence against Women in Donostia and Vitoria. In this situation, the need to establish 15 positions is raised. For Gipuzkoa, there would be five positions, the same as in the previous scenario, with the exception of the position in the Section for Violence against Women in Donostia, which would already be filled.
The TSJPV's proposal will be sent to the CGPJ for submission to the Government, which is responsible for determining the final number of new courts to be created and those corresponding to the Basque Country.
