According to the provisional indictment, the case will be tried by a jury at the Audiencia de Gipuzkoa. The events allegedly occurred in the early hours of April 14, when the defendant, a French national, crossed the border into Irun. He met the victim on Estación street, and the two men subsequently visited several establishments.
Later, they went to an orchard area on the outskirts of Irun. Around 6:00 AM, the defendant allegedly began to assault his companion with the intent to kill. He is accused of repeatedly stabbing the victim in the neck and sides, as well as causing facial fractures.
The prosecution states that the accused then forcefully grabbed the victim by the neck, strangling him, before leaving the scene in his vehicle and returning to France. The Prosecutor's Office considers the acts to constitute murder with aggravating circumstances, requesting 22 years in prison and five years of supervised release.
Finally, the accused grabbed him by the neck with great force, strangling him.
Furthermore, the prosecution seeks a restraining order preventing the accused from approaching or communicating with the victim's son for ten years and requests compensation of 150,000 euros. The private prosecution, representing the deceased's son, is seeking 25 years. The defense, however, maintains that the defendant acted in self-defense.
The suspect was arrested in May of the same year in Hazparne during a joint operation by the Ertzaintza and French police, following an investigation that identified the suspect. The Court of Guard of Irun had issued a European arrest warrant.
