The Vitoria-Gasteiz City Council received a ruling on Thursday, June 18, from the Supreme Court, which dismissed the cassation appeal filed by the owners of the Sagartoki restaurant. This judicial resolution means the sentence is fully final, definitively confirming the legality of the municipal action and the denial of the license for the terrace of this central establishment, making it clear that no further appeals are possible in this process.
This latest resolution brings an end to a lengthy judicial process. The council of the Alavese capital had already obtained two prior favorable rulings in this procedure, both in the first instance and later before the High Court of Justice of the Basque Country.
Following the official notification of the resolution last Thursday, the next administrative step was to initiate the execution of the sentence. The initial plan by municipal services was to formally require the owners of the hospitality business to dismantle the space. However, Sagartoki has already carried out this removal on its own initiative, thus complying with the sentence, and in principle, no additional measures will be necessary.
