Management of the new Zubieta prison is now in the hands of the Basque Government

The Spanish Government's Council of Ministers has approved the transfer of the Gipuzkoa prison, with its opening scheduled for June.

The management of the new Zubieta prison has been transferred to the Basque Government, following the approval of the transfer by the Spanish Government's Council of Ministers, with an anticipated opening in June.

Progress has been made towards the opening of the new Gipuzkoa prison, as the Spanish Government's Council of Ministers approved the transfer of management of this facility to the Basque Government on April 28. This decision was published by the Official Gazette of the Basque Country (BOPV) on May 4, under the title "DECREE 60/2026, of April 29".
As specified in the decree, the transfer of state administration functions and services in penitentiary matters to the Basque Autonomous Community had already been approved by Royal Decree 474/2021, of June 29. Now, with the Donostia prison built and ready to operate, it is necessary to make a decision to modify the patrimonial resources assigned to these functions and services.
Consequently, the transfer of the real estate of the old Donostia prison, located at 1 Martutene street, will be annulled, and in its place, the real estate of the new Zubieta prison will be transferred. The delivery and reception acts will be signed within three months. On June 24, the Basque Government will lose ownership of the old Martutene prison.
The new prison, to be located in the Eskuzaitzeta industrial park in Zubieta, will have an area of 284,255 square meters. After years of delays, the Eskuzaitzeta prison is expected to open, at the latest, in June. As announced by the Basque Government in February, the public company SIEPSE, responsible for the construction, will transfer the property to the General Directorate of Heritage of the Spanish Government, a step prior to the Basque Government receiving the property.
Before the inauguration, approximately two months will be needed to carry out minor adaptation works and to prepare all necessary systems and installations. Furthermore, the new prison will be connected to the nearby incinerator, utilizing the District Heating system to be installed by the Gipuzkoa Provincial Council. This system will use residual heat from the waste-to-energy plant for the prison's climate control systems. Once the Zubieta prison is open, the old Martutene prison will be demolished next year to build 400 homes.
